Representation in Court

We can provide free, independent and confidential advice and representation to homeowners and tenants involved in county court possession proceedings brought on the grounds of arrears. This service is limited and will only be offered to those clients who the local authority would normally have a statutory duty to assist under the homelessness legislation due to our limited staff resources.

In most cases you will be seen by one of our Housing Options Advisors, who will discuss your case in detail and then would normally assist you in completing an N244 application that you would then submit to the courts applying to suspend or delay possession. The form should be supported by 'evidence'. This means that you would need to fill out Part C on the application form or prepare a witness statement dealing with all matters relied upon.

Your Housing Options Advisor will then attend court with you to support your case. The District Judge will consider all evidence provided and will make a decision to award possession or to suspend the possession order. If we have been able to assist you to remain in your home, you will need to keep to the court order which could be the weekly rent plus £3.00 per week (if you are a tenant). If you breach your court order (fail to pay the specified amount each week), your landlord or mortgage lender will re-apply to the court for possession. If you have agreed to pay a specific amount but find that the amount agreed is unaffordable, you can apply to the court to vary the order and the Housing Options Advisors will advise and assist you with this.
