The Officer will assess the situation to see if it constitutes a "statutory nuisance". This means a nuisance in law, not merely an inconvenience or annoyance. In assessing the complaint we consider the time of day, character, frequency and type of smoke.
If the smoke amounts to a statutory nuisance then a Notice may be served to reduce the problem. If the bonfire nuisance continues after the Notice has been served, then the Council can take action in the Magistrates Court. This may result in a fine.
If the Council Officer cannot substantiate a complaint, he/she may recommend that the complainant takes their own case to the Magistrates Court.
