What rights you have as an employee

Smokefree is intended to protect everyone from the effects of secondhand smoke when they are in an enclosed public place or workplace.

Employers will have a legal duty to comply with the new law; anyone who doesn’t comply may be prosecuted for the following offences:

  • smoking in a smokefree place or vehicle
  • failing to display a 'no smoking' sign properly
  • allowing smoking in a smokefree place or vehicle

There will be a national telephone helpline set up from 1 July for people to report non-compliance with the legislation. You will also be able to get advice from the Council’s customer services unit.
