Making alternative provision for smokers

Nothing in the new law obliges an employer or manager of no-smoking premises to provide a smoking area.

Smoking is prohibited by law only in 'wholly or substantially enclosed' public places. Employers may decide that their smoke-free policies will extend to external areas, but this will not be subject to the law.

If you do want to provide a facility for smokers, you may consider an external smoking shelter, but the structure will need to be sufficiently open so as not to be classed as an enclosed space.
